Inheritance Tax in Spain

Inheritance Tax is a tricky issue for owners of Spanish property and so we have asked our financial planning partners, Siddalls, to give you some uncomplicated advice about how you can handle such tax issues in Spain.

Inheritance Tax is a vast subject but there are some particular features of the Spanish system which can surprise the average Briton. The two main differences to the UK are:

The individual recipient is taxed, not the ‘estate’ of the deceased

There is no ‘spouse-to-spouse’ tax free allowance.

What’s more, ex-pats who are residents in Spain are liable to pay Spanish Inheritance tax on all their assets regardless of where the assets are situated, whilst non-residents only pay Inheritance Tax on assets which are physically located in Spain.
